Chris Daughtry may have found fame and fortune as a contestant on American Idol, but he's now finding his former bandmates want a piece of his success. Before Daughtry competed and ultimately finished fourth in season five of the show, he belonged to the band Absent Element. According to the Daily Mail, the former members of the band have filed a lawsuit in Daughtry's native Guilford County, N.C., alleging that the "September" singer lifted the work that he'd done with bassist Ryan Andrews, drummer Scott Crawford and guitarist Mark Perry and used it on Daughtry's first album in 2006. The lawsuit accuses Daughtry of "constructive fraud, breaches of fiduciary duty, unfair trade practices and other deceptive and wrongful conduct." Of particular note is the claim that Daughtry ripped off Absent Element's work on the single "Home" among others, which became a huge hit and was used on subsequent seasons of Idol. A statement about the suit on Daughtry's personal Web site reads: "I am very hurt by these false accusations. The songs listed in this lawsuit were written solely by me and no one else and at this time, I have no further comment."
